The Process

What to expect, step by step.

Every transfer is different, and a registration can take up to three months. Here is the path your matter usually follows, with us keeping you updated at each stage.

  1. Weeks 1 to 2

    Getting started

    • We take instruction and open your file
    • We collect your FICA documents
    • We make contact with everyone involved
    • We arrange any bond cancellation
  2. Weeks 2 to 4

    Preparing the way

    • Compliance certificates are arranged: electrical, gas, electric fence, plumbing and entomology
    • We draft the transfer documents
    • We request the guarantees
  3. Weeks 4 to 8

    Signing and clearance

    • You sign your documents
    • The buyer pays the transfer costs
    • Guarantees are received
    • We obtain the rates and levy clearance certificates
  4. Weeks 8 to 10

    Registration

    • The deeds are examined and lodged, with all three attorney sets lodging together
    • Registration goes through
    • The bank pays out, usually within seven to ten working days

The Gifted Project

A home. A future. A gift.

We believe a home is more than bricks and mortar. It is a place of security, dignity and hope. In 2019 we launched The Gifted Project with a bold mission: to gift a home to a family in need. Since then we have gifted two homes, and every transfer we register brings the next one closer.

  • Every transfer counts. A portion of our conveyancing fee on each transfer we register goes to the project.
  • No extra cost to you. Clients and estate agents contribute simply by entrusting us with their transfer.
  • Collective impact. Every transaction brings us closer to handing the keys to a deserving family.

Good to Know

Your questions, answered.

What documents do I need as a seller?

Your ID, marriage certificate or antenuptial contract if applicable, tax number, proof of residence, a recent municipal account, your bond account number, and your managing agent details if the property is in a complex or sectional title scheme.

What documents do I need as a buyer?

Your ID, proof of residence, marriage certificate or antenuptial contract if applicable, tax number, and your bond approval if you are financing the purchase.

Who pays the transfer costs?

The buyer pays the transfer costs, which include the transfer duty payable to SARS and, where there is a home loan, the bond registration costs. These are separate from the purchase price.

What costs does the seller carry?

The seller usually carries the bond cancellation costs, the settlement of any existing bond, the estate agent commission, and the compliance certificates such as electrical, gas, electric fence, plumbing and entomology.

What will my transfer cost?

Conveyancing fees are guided by a recommended tariff and depend mainly on the value of the property, so every matter is a little different. Rather than show a table that may be out of date, we give you a clear, no-obligation quote up front for your specific transaction. Request a free quote and we will set it all out for you.

How long does a property transfer take?

A typical transfer takes around eight to twelve weeks, and can take up to three months depending on the banks, the municipality and the deeds office. You can see the full step-by-step timeline above.

Why are three attorneys involved in a transfer?

A typical bonded sale involves three attorneys, often appointed at different firms. The transferring attorney, the conveyancer, that is us, moves ownership into the buyer's name. The bond attorney registers the buyer's new home loan for their bank. The cancellation attorney cancels the seller's existing bond for their bank. All three lodge their documents together at the deeds office so registration happens at the same moment.

Do you only work in Umhlanga and Ballito?

Our offices are in Umhlanga and Ballito, but we attend to property matters throughout South Africa.
